Hearn’s Attorneys Demand Final Dismissal: “Government Has No Case and Never Did”

WASHINGTON, D.C. The following is a statement from Davey Hearn’s counsel Norm Eisen of Democracy Defenders Fund, Mary Dohrmann of Washington Litigation Group and Steve Levin and Michael Bromwich of Steptoe LLP, regarding today’s hearing on the motion to dismiss Hearn’s case with prejudice: 

“The government has no case against Mr. Hearn and it should never have been brought. We repeatedly demonstrated that, and we are glad the government finally saw the light. But dismissal alone is not enough. As we argued to the court, the case must be dismissed with prejudice so it can never be brought again. No American should have to continue to endure this kind of harassment when they are innocent. 

“The administration pursued this bogus case to cover for its own installation failures. Its own U.S. Attorney for D.C. admitted that a botched, rushed remodel was the real cause of the peeling paint. This case was always an attempt to distract from those issues. Davey Hearn deserves to move on with his life, not live under the threat of future prosecution.

“We will continue to fight for Davey and are confident justice will prevail.”
