COALITION OF FORMER JUDGES FILE AMICUS BRIEF IN SUPPORT OF JUDGE DUGAN’S MOTION TO DISMISS

MILWAUKEE, WI – A coalition of former state and federal judges has filed an amicus brief in support of Judge Hannah C. Dugan’s motion to dismiss the criminal indictment brought against her by the federal government. The brief warns that the prosecution threatens the foundational principle of judicial independence and opens the door to dangerous executive overreach.


The indictment against Judge Dugan, a Milwaukee County Circuit Court Judge, stems from actions she allegedly took while managing proceedings in her courtroom. On May 13th, a grand jury formally indicted Judge Dugan on one count of obstruction of justice and one count of concealing an individual from arrest.


The amicus brief argues for the dismissal of the case against Judge Dugan, asserting it is barred by absolute judicial immunity. This immunity, akin to that protecting the executive and legislative branches, shields judges from criminal charges for actions performed in their official capacity. The brief warns that allowing the case to proceed would undermine judicial independence, invite political retaliation, and violate core principles of federalism by coercing a state judge to carry out federal immigration enforcement. Furthermore, it emphasizes that such charges risk eroding public trust in the courts by undermining their perceived neutrality and deterring people from seeking justice.


“This case is a five-alarm fire for our democracy and one of its foundations: judicial independence. Prosecuting a judge for how she runs her courtroom is  outrageous and unlawful,” said Amb. Norm Eisen (ret.), the executive chair of Democracy Defenders Fund. If this indictment proceeds,every judge in America will be forced to look over their shoulder before doing anything that might offend those in power. That would be a disaster for our Democracy, which is why we have  safeguards like the principles of judicial immunity addressed in this brief."


“Judge Dugan’s arrest and prosecution are a blatant attack on judicial independence.  By targeting a state judge for her courtroom management, this Administration is signaling its alarming willingness to coerce state courts into executing its federal immigration agenda –  an unacceptable assault on federalism and a grave threat to the public’s trust in our court system,” said Abbe David Lowell, founding member of Lowell & Associates. “Protecting judges from such intimidation is paramount to upholding the rule of law for every American.”
